Living Unit and to the extent of the reasonable pro-rata line costs,
constitute and be deemed an improvement to each such Living Unit. In the
event that Developer or owners of Living Units claiming 5y, through or under
Developer, fail or refuse to connect to and utilize the water and/or sewer
system of General Development Utilities, Inc. when same become available and

make payment of the costs and/or charges, General Development Utilities, Inc.
may enforce the obligation to connect and to make such payment, together with }
all costs of enforcement and collection, including a reasonable attorney's
fee. General Development Utilities, Inc. shall, in addition to other
remedies available to it as prescribed by Florida law, be entitled to have ;

and enforce a mechanic's lien and give notice thereof among the Public Records
- of St. Lucie County.
d. General Development Corporation, as the Developer, reserves
to itself and its successors and assigns all water rights below 400 feet in
depth under all of the properties.
13. Notice is herewith given that the subject property is located
within an area designated by the City of Port St. Lucie as Midport St.Lucie
Assessment District No.l, and is specially benefitted by primary drainage
structures including grassed greenways, permanent water-bodies, wet marsh
areas, water control structures and natural areas which form a part of a
comprehensive drainage plan for the District, said property being subject
to a continuing annual special assessment for the maintainance and repair
of these structures. !n addition, the property may also be subject to
additional special assessments upon petition of 51 per cent of the resident
owners to provide revenues for construction, repair or maintenance of
subsequent improvements.
14. Amendments. These covenants and restrictions may be amended
at any time by the Developer so long as it owns a majority of the lots and
thereafter, by vote of a majority of-the then owners of said lots.
15. Duration. Except as above provided in the paragraph entitled
"Amendments", the covenants and restrictions of this Declaration shall run
with and bind the land and shall inure to the benefit of and be enforceable
by General Development Corporation or the owner of any lot subject to this
Declaration and their respective legal representatives, heirs, successors
and assigns for a term of twenty (20)years from the date this Declaration
is recorded.
