THIS CAUSE, having come on before the Court, for the purpose
of amending that part of the Courts' order of the 26th day of October,
1979, which concerns the default. of the Defendants/Counterclaimants Count IV,
and upon agreement of the parties said Count IV is not defaulted but is
dismissed upon the grounds that it fails to state a cause of action,
therefore, it is hereby
ORDERED AND ADJUDGED, as follows:

(1) That order of this Court dated October 26, 1979, is amended

in part to provide that Count IV of the Counterclaim filed by the
Defendants/Counterclaimants is hereby dismissed for failure to state a
cause of action. f
