Company shall have a reasonable right to enter upon said lands for the purpose of operating, maintaining, and repairing utility facilities now located thereon, and any facilities con- structed thereon as provided in paragraphs number 3 and number 5 herein, including the right to trim such trees, brush and growth t which might endanger or interfere with the operating and safety z of the transportation facility. 2. Company shall repair any damage to Department facilities and shall indemnify the Department against any loss of damage arising out of or caused by Company as a result of the execution of rights hereunder and for which Company is solely responsible. It being understood that Company shall not be responsible for~any loss or damage arising out of or caused by the acts or omissions of Department, repair any damage to Company's facilities and shall, or members of the public, and Department shall insofar as permitted by law, indemnify Company against any loss or damage which Department is solely responsible. It being understood that Department shall not be responsible for any loss or damage arising out of or caused by the acts or omissions of Company or ,members of the public. F 3. Company shall have the right to maintain, construct, improve and relocate electric power transmission and distribution facilities over and across said lands at a height no less than the minimum vertical clearance required for such facilities by state or federal codes, regulations, and statutes currently in effeot as of the date of this Agreement. 4. Department will pay the full cost of alteration, ad3ustment and/or relocation of Company utility facilities located within the said lands whenever such alteration, adjustment, and/or relocation is required by the Department. t 5. If Department grants Company a license to erect and maintain ar~yradditional structures on and within the limits of said lands, any. right of Company to reimbursement for future relocation or impairment of such license rights shall be as mutually agreed upon at the time ~ such license is gran-t'ed. ~N~ DEPARTMEN©OF~~~ 2317 N.
