Dr. Leonello Bertini, an attorney active in his profession, would like to express
that in the territory of the Ecuatorian Republic rules the orders of the Civil
Laws, codified by the Legal Trust, the 29th day of September 1970 and published
in the Supplement Number 104, Official Register of the 20th day of November of 1970.
The article number 28 of the Civil Laws reads:
28: Legal representatives of a person, the father or the mother:, his/hers
tutor or guardian; and legal persons appointed under which the jurisdiction
the person lives under article 589•
The article number 300 of the Civil Laws of Ecuador,reads according to the text:
300: The country's jurisdiction consists of the rights of the parents over
their children not emancipated. The children of any age not emancipated,
are called family children and the parents, in relation to them, family
parents.
The article 328 of the Civil Laws reads:
The legal emancipation becomes effective when:
1st- By death of the father when the mother does not exist.
2nd- By marriage
• 3rd- By the judicial decision that wills property from the deceased father
or mother

4th- By having reached the 18th Birthday

The article number 21 of the Civil Laws reads:
E 21: We call infant or child one who has not reached the age of seven; not having
reached puberty, the boy that has not reached the age of fourteen and the
i
girl who has not reached the age of twelve; a minor, one who has not reached
the eighteenth birthday; adult, one who is past the puberty stage and has
reached the 18th birthday.
Article 1488 of the-Civil Laws reads:
1488: For a person to oblige to another person through an act or voluntary
manifestation is necessary:

1st- To be legally able
2nd- To consent in such act or manifestation, and hislhers consent be not
seized by vice.
3rd- To charge on a just object '
4th- And to have a lawful cause
The legal capacity of a person consists of his person to be able to do for Himself,
and without the administration or authorization from another.
