HomeMy WebLinkAbout0123 cony . cage 2 The article 1489 of the Civil Laws reads: 1489: Every person is legally capable except the persons declared incapable by the Law. The article 1490 of the Civil Laws reads: 1490: They are absolutely incapable the insane, the ones who have not reached puberty and the deafmutes because they cannot relate through writing. Their acts do not affect natural obligations and do not admit a pledge. Also are incapable, the minor adults, the ones who find phohibition in administering their well-being and the juridical persons. But the incapacity of these type of person is not absolute, and their acts could have validity in certain circumstances and under certain circumstances determined by the Law. Besides these incapabilities, there are others that consist of the prohibition that the Law imposes on certain persons to execute certain acts. The article 1491 of the Civil Laws reads: 1491: What a person executes in the name of another person having the authority by her or by the Law, to represent her, provides in relation to the represented the same effect as the person himself. By power of the legal resolutions quoted here, our children Jose Rafael Bertini Chiriboga, of six years of age and Lucia Bertini Chiriboga, of three years of age, not being of age, cannot act in their behalf and on contracts relative to them, but represented legally by his parents Paulina Chiriboga de Bertini and Dr. Leonello ~ Bertini, under which jurisdiction they live under. The legal resolutions above and the exposed declarations, can be consulted before the Ecuatorian public.officials of the exterior services, acredited before the Goverment of the United States of America in the North American Continent, competent ~ in .the subject, without prejudice of the norms of the Private International Rights.
