THIS CAUSE coming on for hearing upon the Motion to
Dismiss the first Amended Complaint, filed on behalf of
the Defendants, CITY OF FORT PIERCE, FLORIDA, JAMES POWELL,
Chief of Police, and JACK NORVELL, Captain of Police, and
the Court having heard argument of counsel, and the Court
finding that there should be a separate prayer for relief
with each Count, and the Court further finding that there
should be separate Counts as to; (1) a claim for reinstate-
ment by the Plaintiff; (2) damages; and the Court being
otherwise duly advised in the premises, it is upon consi-
~ deration

ORDERED AND ADJUDGED that the Motion to Dismiss the
j first Amended Complaint, be and the same is hereby granted,
and the Plaintiff shall have twenty (20) days from the date
of this Order to amend his Complaint.
