This matter came on to be heard on the motions of
intervenor, MONROE SPEN, Trustee, to strike affirmative
defenses and dismiss counter-claim of the Defendants.
Upon consideration, it is
ORDERED
(1) The motions to strike affirmative defenses are
denied .

(2) The motions to dismiss the counter-claim are granted '
because the time, place; and nature of the matters set forth
therein are not alleged with sufficient particularity to allow
intervenor to frame his response thereto.
(3) Defendants shall have 20 days to file an amended
counter-claim.
