O R D E R
This matter came on to be heard on Plaintiff's motions for
sanctions,
It appearing that this court ordered on July 26, 1977 the

following:

..that the Motion to Compel Discovery be granted
as to the request for copies of Federal Income Tax re-
turns of Lawrence F. Brinster for the years commencing
with the first contribution by Henry Spen & Company,Inc.
to Henry Spen & Company,Inc.Profit Sharing Trust, and
all subsequent years;'
..that the portion of the Motion to Compel Dis-
covery be and is hereby granted~as to the production '
of all documents relating to the investment and re-
j investment of Lawrence F. Brinster's share of Henry
j Spen & ComYpany,Inc.,Profit Sharing Trust.

It further appearing that the court ordered on October 10,
the following:
That in the event there is an impossibility of
performance of compliance with the order compelling
discovery, entered by the Court July 26, 1977, by the
Defendant, Lawrence F. Brinster and Mary Irene Brin-
ster, said Defendants shall file an Affidavit citing
specifically how and why they are unable to comply
with the order compelling discovery and provided
further that said Defendants, Lawrence F. Brinster
and Mary Irene Brinster, shall execute authorization
forms to the Internal Revenue Service permitting
~ Monroe Spen to acquire copies of Federal Income Tax
Returns, and provided further that Defendants,Lawrence
F. Brinster and Mary Irene Brinster, shall furnish
names and addresses of all accountants preparing in-
come tax returns for the Brinsters, commencing with
the first contribution by Henry Spen and Company,Inc.,
to the Company's Profit Sharing Trust and all sub-
sequent years.
