l. Owner represents and warrants that he is the owner of the
above-described real property and that there are no liens or encum-
brances against said property other than the aforementioned mortgage
and real estate taxes accruing subsequent to December 31, 1978.
2. The current principal balance of the indebtedness evidenced
by the aforementioned promissory note is the amount of U.S. $12,880.00
and accrued interest on said indebtedness has been paid through
May 15, 1979.
3. The aforementioned indebtedness_of Mortgagor shall be paid
in accordance with the terms of the Replacement Promissory Note; a
copy of which is attached hereto and by reference made a part hereof. .
and said purchase money mortgage heretofore given by Mortgagor to Mort- }
gages is hereby modified to secure the payment of the indebtedness to
Mortgagee in accordance with the terms of the Replacement Promissory
Note.
4. Except as hereby modified, all other terms and conditions
of the aforementioned mortgage are hereby ratified, confirmed and
approved. i
5. Nothing contained herein shall be construed to impair the
security of Mortgagee under the aforementioned mortgage, and said
security shall remain effective as of the date of its original
protection.
6. This agreement shall be binding upon the parties hereto and
their personal representatives, heirs., beneficiaries, successors and
assigns.
IN WITNESS WHEREOF, the parties hereto have executed this
agreement in duplicate, each of which shall be considered an original, `
on the day and year first above written. .
