FINALLY, IT IS ORDERED AND ADJUDGED, that the Co-Defendant,
D&M MOBILE HOME PARK, INC., acting through any of its owners,
employees, and/or agents, shall not dispose of, tamper with,
or destroy or in anyway prevent from being available for view at trial
the Flint and Walling (F&W), three horse power centrifugal pump
model number C21I5430 and/or C2116130 and/or the Square D Company pressure
switch class 9613, Series B, electric solenoid, both of which
items are referred to in an answer to question 3 of the Defendant's
AIRWICK POOL PRODUCT, INC.'S, d/b/a AIRQUATIC'S Interrogatories
to the Defendant, D&M MOBILE HOME PARK, INC., served on or about
May 14,-1975. The court does hereby find that the existence and
availability of both of the above items may be necessary at trial
and because they may by material and relevant exhibits, the court
does therefore grant the Co-Defenant's, AIRQUATZC, Motion for
Temporary Injunction upon Notice preventing destruction, removal
or non-availability of said items. In the event either or both of
said items need to be replaced for the proper functioning of the
D&i4 MOBILE HOME PARK's water system between the date of this order
and the time of trial, the court orders D&M MOBILE HOME PARK, INC.
acting through its owners, employees or agents to either personally
remove the defective item and/or to supervise the removal of the
defective item in such•a manner as to not unduly injure or destroy
said item and to turn said item over to D&M MOBILE HOME PARK, INC.'s
attorney for safe keeping until trial.
