ORDER -
After due notice by or to all parties affected, on
November 21, 1979, a hearing was held before the Court with
respect to the matters disposed of by this Order; upon
consideration, it is,
ORDERED AND ADJUDGED that the Motion for Compulsory
Physical Examination filed herein by the Defendants, GEORGE }
E. CARTER d/b/a BOWEN WATER CONDITIONING SERVICE-and STATE
FARM FIRE AND CASUALTY' COMPANY, is denied; in denying this
Motion, the Court has taken into consideration the fact that
this Court has previously on November 2, 1979, entered its
Order requiring the Plaintiff, EILEEN M. McBRIAR,to submit
herself to a physical examination to be conducted by Joseph
H. Moll, M.D., an orthopedic surgeon, practicing in Stuart,
Florida. The Plaintiff shall only be required to submit herself
to one compulsory physical examination at the request of the
various Defendants herein. It is further
ORDERED AND ADJUDGED that at the trial of this matter,
no reference shall be made by any party to the examining
physician, Joseph H. Moll, M.D., as a "Court appointed physician".
