SEPARATION AND PROPERTY SETTLEMENT AGREEM~NT

THIS AGREEMENT, made this ~ day of ~ 1979,
between THOMAS M. McFREDERICK, hereinafter referred to as the Husband,
and SHAAROPJ SUE McFREDERICK, hereinafter referred to as the Wife.
WITNESSETH:
WHEREAS, the parties hereto have lived together as Husband
and Wife, having been married to each other at Ashland, Ohio, on or
about the / g~ day of June, 1966; and
WHEREAS, two children have been born as issue of said
*++arr~aQe= and there are no other children contemplated at this time;
and
WHEREAS, differences have arisen between the parties, because
of which they will not hereafter cohabitate together, and the parties
have agreed to live separate and apart in the future; and
WHEREAS, the parties desire to settle and adjust forever all
rights of alimony, property rights, and all other rights arising out
of the relationship of the parties; and

WHEREAS, the Husband and Wife agree between them on a full
} property settlement which shall obtain and be binding upon both

parties hereto, their respective heirs, executors, administrators and
' assigns,.and likewise in the event of the death of Husband or Wife,
or in the event that either of the parties hereto shall ever secure
a decree of divorce or an annulment against the other party; and
WHEREAS, the Husband and Wife respectively represent and
~ warrant to each other that each has carefully read and understands
this entire Separation and Property Settlement Agreement, is fully
~ cognizant of the terms hereof, and has been fully advised of his or
her rights and obligations in respect of all matters affected by this _
Separation Agreement, and that all of the provisions hereof are for
the best interest of the parties hereto, and have been mutually agreed

upon between them without coercion, duress or undue influence on the

part of either of the parties hereto as against the other party hereto.
