HomeMy WebLinkAbout1118 Nothing contained in this paragraph or elsewhere in this Agreement shall be deemed a waiver of, or a limitation upon, the Wife's right to prosecute, perfect and satisfy any claims which she may have against the estate of the Husband by virtue of the Husband's default in the payment of any and all sums provided for in this Agreement to be paid by the Husband to the Wife, or to enforce the collection of the payments required by the foregoing paragraphs which may become due after the death of the Husband. ELEVENTH: (a) The Husband represents and warrants to the Wife that he has fully paid all income taxes on all joint returns previously filed by the parties; that no interest. or penalties are due and owing; and that no tax deficiency, proceeding or audit is pending or threatened, to the best of his knowledge. (b) If a deficiency assessment is made in connection with any joint income tax returns filed by the. parties, the Husband shall notify the Wife at~once in writing and shall pay the amount finally ascertained to be due, with any interest and penalties, and any expenses, including attorneys' fees, occasioned by the deficiency. (c) The Husband in all respects shall indemnify the Wife E against, and hold her harmless from, any deficiency assessment or tax lien arising .out of any joint return previously filed or hereafter filed by the parties as well as any related damages and expenses whatsoever. (d) If there be a refund for the year 1978, it shall belong to the Wife after deducting certain account balances previously specified. _ $~~K 321 PM~E X117
