HomeMy WebLinkAbout1119 . : TWELFTH: Nothing in this Agreement shall be construed as a relinquishment by either of the parties hereto, of the right to sue the other for a dissolution of their marriage in any court having competent jurisdiction. THIRTEENTH: In the event that any Final Judgment by a court of~competent jurisdiction shall be entered dissolving the marriage of the parties hereto, this Agreement shall be incorporated in any such Judgment. It is agreed,.however, that this Agreement shall in any case and at all times survive any such Judgment and the terms and provisions hereof shall prevail and obtain. The parties hereby expressly agree that the terms of this Agreement, including those which require the payment of money, may be enforced subsequent to the entry of a Final Judgment, Dissolution of Marriage, by contempt pro- ceedings and it shall not be necessary for the parties or either of them to resort to a separate action for a breach of said term or terms. FOURTEENTH: The failure of either party to insist upon strict performance of any provision of this Agreement shall not be deemed a waiver of the right thereafter to insist upon performance of that or any other provision of this Agreement. FIFTEENTH: The terms and conditions of this Agreement shall I be construed and shall be enforced according to the laws of the e State of Florida. SIXTEENTH: This Agreement shall be and continue to be binding upon the parties hereto, their respective heirs, executors, administra- tors and assigns, irrespective of the death of the Husband or of whether the marriage between the parties hereto continues or is dissolved by a Judgment for dissolution of marriage. SEVENTEENTH: This Agreement may be executed in any number of . counterparts, and one of which shall be deemed to be the original, although the others are not produced. ao~K321 FaGE1118 -S_
