For value received we, jointly and severally, as principal, promise to pay
without defalcation to the order of RICHARD J. POZNIAK
at the office of said payee in Fort Pierce, Florida, the sum of
----Eighty Thousand ($80,000.00) and no/100-------------------- ~
~~ith interest from date at the rate of ten (10) $ per annum, in
installments, payable as follows, to-wit:
One Thousand Fifty-Seven ($1,057.22) and 22/100 Dollars }
on the 1st day of January 1980, and the ~ '
sum of $1,057.22 on the day of each succeeding
month thereafter until the whole sum named is fully paid.
Each installment shall first be applied in payment of the interest and
then on the unpaid balance of the principal sum. If default is made in
the payment of any installment when due, then, at the option of the payee,
all the remaining installments shall become due and payable at once.
Should it become necessary to collect this note through an attorney, t
~ either of us, whether maker, surety or indorser on this note, hereby
j agrees to pay all. costs of collection, including a reasonable attorney's
fee.

The makers, sureties and indorsers hereof severally waive presentment,
~ protest and notice of protest for non-payment of this note and agree
that the time of its maturity may be extended before or after maturity
and do~further severally agree to any renewal thereof before or after
r.~aturity, without notice of them.

If any amounts due are prepaid, the payor shall pay an additional ten
(10$) per cent of the principal amount prepaid for the privilege of pre-
payment.
The property secured herein cannot be transferred without the consent
of the mortgagee. The mortgagee agrees that in the event of the mental
or physical disability of the owner of the mortgagor corporation, Donald
E. Lord, that same may be transferred upon compliance with all require-
ments of Hardee's to a responsible individual who will assume all obli-
gations hereunder.
We, the undersigned, guarantee payment of this note, jointly and severally.
