That no waiver of any covenant herein or of the obligation secured hereby shall at any time thereafter be held to be a waiver of the terms hereof or of the note secured hereby. 13. That if the mortgagor default in any of the covenants or agreements contained herein, or in said note, then the mortgagee may perform the same, and aQ expenditures (including reasonable attorney's fees) made by the mortgagee in so doing shall draw interest at the rate set forth in the note secured hereby, and shall be repayable immediately and without demand by the mortgagor to the mortgagee, and. together with interest and costs accruing thereon, shall be secured by this mortgage. 14. The mortgagor further covenants that should this mortgage and the note secured hereby not be eligible for insurance under the National Housing Act within Si.Xty Days from the date hereof (written statement of any officer of the Department of Housing and Urban Development or authorized agent of the Secretary of Housing and Urban Development dated sub- sequent to the 60 days time from the date of this mortgage, declining to insure said note and this mortgage, being deemed con- ::lusive proof of such ineligibility), the mortgagee or the holder of the note may, at its option, declare all sums secured hereby immediately due and payable. 16. Attorney's fees, as used in this Mortgage and in the Note, "Attorney's Fees" shat! include attorney's fees, i[ any, which shall be awarded by an Appellate Court. The covenants herein confined shall bind, and the benefits and advantages shall inure to, the respective heirs, executors, adminis- trators, successors, and assigns of the parties hereto. Whenever used, the singular number shall include the plural, the plural the singular, and the use of any gender shall include all genders.
