FINAL JUDGMENT
THIS CAUSE came before the Court on non-jury trial
on October 9 and 11, 1979. The Court received testimony,
memoranda of law and argument of counsel for all parties.
From the testimony and exhibits introduced at trial, the Court
finds:
Count I is an action on a check. #

A summary judgment .was entered in favor of Defendant,
Hutchinson Island Limited Partnership and Gulf Oil Real Estate
Development Company on Count II.
Count III is an action for equitable relief for

~ specific performance, appointment of a receiver and an accounting.

A partial summary judgment was granted in favor of
Hutchinson Island Limited Partnership as to the appointment of

a receiver.
Count IV was an action for breach of the so-called
"tri-party agreement".
Counts V and VI are actions against Robert C. Amann,

Marie A. Amann and Ologistics, Inc. on two promissory notes. A
~ stay order in bankruptcy has been issued for Ologistics, Inc.
and Marie A. Amann.
The Defendant, Hutchinson Island Limited Partnership
and Gulf Oil Real Estate Development Company, the general
partner, (hereinafter referred. to as HILP) entered into a con-
tract with Ologistics, Inc., (hereinafter referred to as
i1t
