ORDER
THIS CAUSE having come on to be heard upon the Defendant's
Motion to Strike Count II of the Plaintiff's Amended Complaint
and the Defendant's Motion to Dismiss Count III of the Plaintiff's
Amended Complaint, and the court having heard argument of counsel
and the Court being fully advised in the premises, -
IT IS ADJUDGED that:
1. The Defendant's Motion to Strike Count II of the Plain-
tiff's Amended Complaint is granted, although the Plaintiff shall
have five (5) days leave to amend if the Plaintiff wishes to
assert an additional count against Parman Florida, Inc., but not
j James Horan personally.
I 2. The Defendant's Motion to Dismiss Count III of the
~ Plaintiff's Amended Complaint is granted; however, the Plaintiff
shall have five (5) days leave to amend.
ORDERED at Fort Pierce, St. Lucie County, Florida on the
day of 1979.
