Units in 2 buildings and shall be completed (if the Developer
shall elect to build it) by the 31st day of August, 1982 (if the
Developer shall elect to build it). Phase C shall have 22 Units
in one building and shall be completed (if the Developer shall
elect to build it) by the 31st day of August, 1982.
(3) Phase B and Phase C shall include the land, parking
areas, walkways or roadway as is shown on that portion of said
Exhibit No. "I" as is applicable to that particular phase. These
items, as well as any others shown on Exhibit "I" as being a
portion of Phase B or C, shall not become a part of this Condominium
unless and until Phases B and/or C are added to the Condominium
by submission to the Condominium Act. No recreation areas or
facilities are proposed to be included in any phase (other than
open space) and, since there are to be no such facilities in any
phase, no personal property will be provided for such facilities.
(4) Phases B and/or Phase C may be added to the Condo-
minium by recording an amendment to this Declaration in the
Public Records of St. Lucie County, Florida, declaring this
submission of that particular phase to condominium ownership
under the Condominium Act as a part of Beachtree II, a condominium.
Neither the approval nor the consent of any Unit Owner or the
Association (as hereinafter defined), shall be required for such
amendments. Notice, however, of the amendment shall be given
pursuant to the requirements of the Condominium Act.
(5) Upon the submission of each additional phase to
condominium ownership, the share of Common Elements and Common
Surplus shall be adjusted in accordance with Article V hereof.
Likewise, upon the addition of such subsequent pleases, the total
number of votes in the Condominium shall be adjusted as follows,
e.g. Phase A = 20 votes; Phase A and B = 42 votes; Phase A, B and
C = 62 votes. See Article VI hereof.
(6) The Developer shall have the sole discretion to
determine whether such additional phase or phases shall be added
to the Condominium as aforesaid. If any such phase or phases are
not added to the Condominium, Developer shall not be obligated to
provide to the Condominium a_11 or any portion of such phase or
phases not so added.
ARTICLE II

DEFINITIONS
When used in this Declaration of Condominium, the following
~ terms (unless the context clearly requires otherwise) shall have
the following meanings:

A. ASSESSMENT means a share of the funds required for the
payment of Common Expenses which,-from time to time, is assessed
against a Unit Owner.

B. ASSOCIATION OR CONDOMINIUM ASSOCIATION means BEACHTREE
s II, INCORPORATED, a Florida nonprofit corporation, the entity
responsible for the operation of the Condominium.
C. BOARD OF DIRECTORS means the Board of Directors of the
Condominium Association.
} D. BYLAWS means the Bylaws of the Condominium Association,
a copy of which are attached as Exhibit No. "2" to this Declaration
of Condominium and incorporated herein by reference, as the same
may be from time to time amended.
E. COMMON ELEMENTS means those portions of the Condominium
Property not included in the Units.
