first mortgage y some circumstances fails to be a first mortgage,
but it is evident that it is intended to be a first mortgage, it
shall nevertheless, for the purpose of this Declaration and
Exhibits annexed, be deemed to be an Institutional first mortgage.
M. No Warranties. The Developer s~ecif ically disclaims
making or inten ing to ave made any warranty or representations
in connection with the Condominium Property or the Condominium
Documents, except as specifically set forth therein, or in Chapter
718, Florida Statutes, and no person shall rely upon any warranty
or representation not so specifically made.
N. T.V., Water and Sewers a Service. In order to insure
the Condominium o a equate an uniform television cable service,
water service and sewage disposal service, the Developer shall
have and hereby reserves the exclusive right to contract for the
servicing of this Condominium and the Unit Owners therein with
said services. The use of such service(s) may be mandatory.
This right may be terminated by a waiver executed by the Developer
in writing and delivered to the Condominium Association.

O. Furniture: All furniture that may be included in the
initial sale of a Condominium Unit shall become the personalty of
the Unit Owner and shall not be a Common Element or Limited
Common Element. Said furniture shall be the maintenance, replace-
ment and repair obligation of the Unit Owner.
P. No Time - Share Estates. No time - share estates shall
be, will or may be created with respect to Units in any phase of
this Condominium.
Q. These Documents Control. Notwithstanding the fa.:t *_hat
the present provisions of the Condominium Act of the State of
Florida hereby are incorporated by reference herein, the provisions
of this Declaration and of the Exhibits hereto shall be paramount
to the Condominium Act as to those provisions where permissive
variances are permitted; otherwise, the provisions of said Condomi-
nium Act shall prevail and shall be deemed incorporated herein
and therein.
R. No Partition. No Unit Owner shall bring, or have any
right to bring, any act of partition or for division of the
Condominium Property.
S. Controlling Law. This Declaration of Condominium and
'j the Exhibits thereto shall be interpreted under the laws of the
State of Florida.

IN WITNESS WHEREOF, HUTCHINSON ISLAND LIMITED PARTNERSHIP, a

signed in its name by its proper general partner, the day, month
