HomeMy WebLinkAbout2696 application because of the complaints of citizens. The rezoning of this property first came before the City Commission of Fort Pierce at a public meeting on February 5, 1979. The City attorney at that time advised-the City Commissioners that an application for a beer and wine license had been made on this property, and the City had been requested to certify whether or not the zoning on this particular piece of property permits the sale of beer and wine under the particular license for which application had been made. The minutes re- flect that the City Commissioners were clearly advised that this property which was zoned C-3 does permit a convenience grocery store to be located at that location, and that you don't find any definition of a convenience store which prohibits or limits the type of sales to exclude beer and wine. The City Commission then, on its own motion, moved to prepare and advertise an ordinance rezoning this property back to R-6 zoning, and send this ordinance to the Planning Board for a recommendation. (Court Exhibit "O", Pages 7, S and 9) The Commission further instructed Mr. Moore to withhold any designation of the beverage license until the zoning matter was completed. Public advertising for rezoning of this property from E commercial (C-3) to residential (R-6) was then held before the { City Zoning Commission and the City Commission, resulting in the zoning of this property being changed to residental (R-6). This suit was filed on February 19, 1979, and the re- zoning of this property was not completed until on or about April 16, 1979 by Ordinance No. H-65.
