THIS CAUSE coming on to be heard on Defendants`
motions to strike punitive damages and loss of earning
capacity, and the Court having considered argument of counsel,
memoranda of law submitted by Defendants, and Plaintiff having
submitted nd memorandum, said motions to strike are denied,
except Appalachian's mot-ion to strike as to punitive damages
is granted, since Appalachian does not insure employers.
Sterling Insurance Company v. Hughes, 187 So.2d 898 (3 DCA
1966). ~ -
