MODIFICATION, RELEASE, AND ASSUMPTION AGREEMENT

The parties to this agreement are F. JEAN RODGERS, hereinafter
called "Lender" and JOSEPH MOLA, JR., hereinafter called "New Obligor".
WHEREAS, ANTHONY A. ABBATIELLO and ROSE ABBATIELLO, his wife,
hereinafter referred to as the "Original Obligors" executed a Promissory Note
on February 1, 1973, evidencing a principal indebtedness of Twenty Eight
Thousand ($28,000.00) Dollars, secured by a Mortgage upon real property known
as Lot 15, Block 8, River Park, Unit One, a Subdivision according to the Plat ,
thereof as recorded in Plat Book 10, at Page 69, of the Public Records of St.
Lucie County, Florida, and
WHEREAS, said Original Obligors are conveying the property to
said Mortgage to the New Obligors, and
NOW THEREFORE, in consideration of the mutual promises and
covenants contained herein the parties agree as follows: '
--1.,f1~; 1. The undersigned New Obligor hereby expressly assumes and
agrees to pay the indebtedness represented by the aforementioned promissory
-:,3t~j note which indebtedness is in the sum of Twenty-Eight Thousand and No/100
PT`--{II} ($28,000.00) Dollars, due according to the terms and conditions of the afore-
- mentioned note and mortgage without defense or offset and agree to be liable
~ therefore as fully and to the same extent as if the original maker or Original
<< Obligors thereon. In addition the undersigned New Obligor agrees to personall
_.~j perform and to fully abide by all of the terms and conditions set forth in the
. ~ aforesaid Note and Mortgage.

2. The provisions of said Note and Mortgage are hereby express
ly reaffirmed except as follows:
Est (a) The New Obligor does hereby pay the sum of Four
L~y _ yy Hundred Three and 92/100 ($403.92) Dollars, which payment shall be applied
in its entirety to principal reduction thereby reducing said Mortgage and
Note to the present principal balance of indebtedness of Twenty-Seven Thou-
sand and No/100 ($27,000.00) Dollars.
(b) Interest on the subject obligation shall henceforth
accrue to the Lender at the rate of Nine and one quarter percent (9 1/4X)
per annum, effective September 17, 1979.
(c) The regular amortizing monthly payment due in accor-
dance with the terms of the aforementioned Note shall henceforth be in the
sum of Two Hundred Thirty One and 23/100 ($231.23) Dollars due and payable
on the same day of each and every month as called for by the subject promiss-
ory note, effective October 1, 1979. _
3. Except as specifically designated herein, nothing here
shall constitute a change or amendment to the aforementioned Promissory Note
and Mortgage the provisions of which are specifically reaffirmed by the New
Obligor.
4. This agreement is binding upon the parties, their heirs
and assigns.
