(b) Drainage Easement contained in that certain Warranty
Deed from Glenn M. Averill and Jessie M. Averill, his
wife to William H. Byington recorded tiay 10, 1924 in
Deed Book 56, Page 236, Public Records of St. Lucie
County, Florida.
(c) Right of way contained in that certain Easement from
Francis Kerr Keister to the Central and Southern Florida
Flood Control District recorded December 19, 1958, in
O.R. Book 243, Page 626, Public Records of St. Lucie '
County, Florida. '
Together with a security interest which is hereby granted
by Mortgagor to Mortgagee in and to the following described
collateral now owned or hereafter acquired by Mortgagor and
located on the above described real estate including, but not
limited to, the collateral described on the attached Exhibit
"B" incorporated by reference herein and further including all
additions, accessions, replacements, improvements, repairs and
substitutions to said collateral and the proceeds thereof. The
foregoing grant of the security interest is intended to be within
the meaning of the Uniform Commercial Code as adopted by the ,
State of Florida, and Mortgagor agrees to execute and deliver
to tortgagee as Mortgagor may be directed by the Dortgagee
such financing statements and further assurances as Mortgagee
may deem necessary to perfect and preserve the lien hereof
on the collateral described herein or intended to be subject
hereto, and Mortgagor authorizes such statements and assurances
and the iiortgage and Security Agreement to be recorded and re-
recorded, filed and refiled at such places and times as may be
required by law to so create, perfect, and preserve the lien
hereof against said collateral. Where the sense of this
instrument requires the words Secured Party shall be read
in lieu of Mortgagee and the word Debtor shall be read in
~I lieu of Mortgagor.
15. This tortgage is given and accepted upon the express
provision that should the undersigned sell, divest, transfer,
relinquish or lose its .right, title, or interest in the loan
~ security, or any portion thereof during the term of this Mortgage,
either voluntarily or by operation of law, without the prior
~ written consent of the Mortgagee, which consent will not be
` unreasonably withheld, then the Mortgagee, at its option, may
accelerate all or any part o£ the indebtedness secured hereby and
thereafter enforce the collection thereof as herein provided or in
~ any other manner provided by law.
16. tortgagor further covenants and agrees to comply with
all Federal, State and local laws and regulations with regard
to the protection of the environment including, without limitation,
bath Federal and State air and water quality standards and noise
abatement regulations and local zoning ordinances.
