ORDER

THIS CAUSE having come to be heard on the foregoing
Motion, stipulated to by all parties in this cause, and
the Court having considered same and being otherwise fully '
advised in the premises, it is thereupon
ORDERED AND ADJUDGED as follows: i
1. This cause of action and the Complaint filed
herein is hereby dismissed as to Defendant, First National '
Bank of Ft. Pierce.

2. The Crossclaim of First National Bank of Ft. r
Pierce is hereby dismissed, without. prejudice to said Crossclaimant
refiling a separate action to enforce the remaining portion
of its obligation which was not released with the property
which is the subject matter of the cause of action herein.
