WITNESSETH: That Grantor, for and in consideration of the sum of TEN (110.00) DOLLARS and other good and valuable consideration paid by Grantee, the receipt of which is hereby acknowledged, has granted, bargained, and sold to Grantee and Grantee's heirs and assigns forever the following described real property situated, lying and being in St. Lucie County, Florida, to wit: The Condominium Parcel known as Apartment X24-p of Phase VII of HIGH POINT OF FORT PIERCE CONDOMINIUM SECTION II (the "Condominium") according to the Declara- tion of Condominium thereof, recorded in Official Records Book 304 at Pages ~ f~i through 1508. of the Public Records St. Lude County, Florida as such Declaration may have been amended by any amendments thereto hereto flied in the Public Records of St. Lude County, Florida including, but not liznited to, any amendment to add the aforesaid Phase to the Condominium (if such Phase be other than Phase I thereof) . . t Grantee, by acceptance hereof, and by agreement with Grantor hereby expressly assumes and agrees to be bound by and to comply with all of the covenants, terms, conditions and provisions set forth and contained in the j aforedescribed Declaration of Condominium, including, but not limited to, the l obligation to make payment of assessments for the maintenance and operation of the Condominium which may be levied against the above described Apart- went. Grantee expressly acknowledges the existence ~ of a Settlement Stipula- tion and Agreement for and Grant of Easements- and Other Rights (the "Settle- went Stipulation") and a Declaration of Protective Covenants and Restrictions {the "Protective Covenants"), as hereinafter set. forth. The Settlement Stipu- lation provides for this Condominium to be served by certain facilities of High Point of Fort Pierce Condominium Section 1 and the Protective Covenants provides for certain land use covenants upon the land areas described therein (including, but not lUnited to, portions of the land areas included within this Condominium) and provides for certain drainage easements and other ease- ments and rights including, but not limited to, the "Roadway Easement", - "Sewage System Rights", "Water System Rights". and "Future Development' Property Drainage Easement", aA as are more particularly described therein, all in addition to the other matters set forth in the Settlement Stipulation and i'~ Protective Covenants, which other matters include, but are not limited to, the obligation to pay certain "Assessments" as are respectively set forth in the Settlement Stipulation and Protective Covenants .
