PFf31FFER husband and wife, as joint tenants with right of survivorship, doing business as CARPETS BY FIVE-FOUR, 2306 Oak Drive, Fort Pierce, Florida, hereinafter collectively called "Mortgagor", in consideration of the. sum of ONE DOLLAR ($1.00) and other good and valuable considerations, the receipt and sufficiency of which is hereby acknowledged, - and for the purpose of securing the payment of the indebtedness hereinafter described and all extensions, renewals, substitu- tions and changes in form thereof, together with all interest, charges and fees thereon, has mortgaged and does hereby mortgage unto AGRICO CHEMICAL COMPANY, Bank of Oklahoma Tower, One Williams Center, Tulsa, Oklahoma 74172, hereinafter called "Mortgagee",.(whether one or more), the following =~j described real property situated in the County of St. Lucie, ' State of Florida, to-wit: 1 Lots 5 and 6, Block 1, less the South 15 feet thereof, KILLER'S SUBDIVISION, ' r according to plat thereof recorded in Plat-Book 4, page 45, public records i,f St , Lt1~i a C'guntys Florida together with all and singular the tenements, hereditaments, and appurtenances thereunto belonging or in any wise apper- taininq, including all buildings and improvements now or hereafter placed thereon, with ventilation fans, together with rents, issues and profits therefrom, all of which real property, tenements, hereditaments, appurtenances, buildings, improvements, rents, issues and profits are hereinafter referred to collectively as the "Mortgaged Property". TO HAVE AND TO HOLD the above described Mortgaged Property together with all and singular rights, heredi- taments and appurtenances in any wise belonging_or appertain- ' ~ ing thereto unto the Mortgagee forever. The undersigned Mortgagor covenants with and warrants to the Mortgagee that Mortgagor is lawfully seized in fee simple title of the Mortgaged Property; that Mortgagor has good right to sell and convey the same and to mortgage the same as aforesaid; that said Mortgaged Property is free and clear of all former grants, charges, taxes, judgements, mortgages, liens, claims and encumbrances of whatever nature made or suffered to be made by Mortgagor; and that i:he undersigned Mortgagor will warrant and defend the title to said Mortgaged Property unto the Mortgagee and its successors and assigns, forever, against all claims and demands of any person or persons whomsoever, save and except for all recorded easements, licenses, restrictions, rights-of-way, rights of third parties or other recorded instruments affecting the property, real estate taxes for the current tax year not yet due and payable, building and zoning ordinances, regulations, prohibitions and requirements imposed by any governmental authority, and any state of fact which an accurate survey would disclose.
