Mortgagor further grants, mortgages, sells, conveys and
assigns unto Mortgagee, with full right of substitution in
the place of Mortgagor, all rights of Mortgagor under or
with respect to all prior warranties and covenants of any
kind whatsoever, whether personal or real, pertaining to the
above described real property, the title thereto or any
interest therein.
This Mortgage is given to secure a part of the purchase
price of the above described Mortgaged Property and as
security for performance of each of the covenants of the
Mortgagor contained herein and as security for the payment
to the Mortgagee of the principal sum of SIXTY THOUSAND
DOLLARS~($60,000.00) according to the terms and conditions
of a certain Promissory Note of even date herewith made,
executed and delivered by the undersigned Mortgagor, as
maker, payable to the order of the M~~tgagee, as payee
(hereinafter called the "Fromissory Nate"), said Promissory
Note being in the principal sw~i of SIXTY THOUSAND DOLLARS
($60,000.00) and bearing inL_.:,-est from the date thereof on
the unpaid principal balance computed at the rate of fifteen
percent (15~;) per annum, interest payable on December 30,
1980.
This Mortgage is also security for the payment of all
extensions, renewals: substitutions ana chanycs in fa~~ of
the indebtedness represented by said Promissory Note, which
extensions or renewals of said Promissory Note and this
Irortgage may be from time to time and for any term or terms
with or without notice to the Mortgagor.
AND for the considerations aforesaid, the undersigned
Mortgagor covenants and agrees with the Mortgagee, its
successors and assigns, as follows:
1. To pay all sums secured hereby promptly and as the
same become due, time being spECifically of the essence of
each and every covenant herein contained and contained in
the Promissory Note which this Mortgage secures.
2. To pay promptly when due all taxes, general and
special assessments, penalties and charges thereon levied
upon or against the mortgaged property or any portion thereof
or the indebtedness secured hereby; to pay promptly when due
all other taxes and assessments which may become~a lien upon
said mortgaged property or any portion thereof at least ten
(10) days before the same become delinquent. The Mortgagor
agrees to furnish to the Mortgagee herein upon demand therefor
and prior to the time that the same become delinquent, a
duplicate tax receipt evidencing the timely payment of all
taxes or assessments of every nature levied or assessed
against the mortgaged property or any portion thereof.
3. No sale or conveyance of all or part of the mortgaged
property shall in any way relieve the Mortgagor of his
primary liability for the payment to the Mortgagee of all
indebtedness secured hereby nar shall the same relieve the
Mortgagor of his primary liability to perform each and all
. of the covenants, agreements and obligations contained
herein or in the Promissory Note secured hereby.
