5. RICHARD P. SIMONE, whose address is 269 North
Poplar Street, North Massapequa, Long Island, New York 11758,
and who is qualified under the laws of the State of Florida to
serve as personal representative of decedent's estate is entitled
to preference in appointment as personal representative because
he is the nephew of the decedent and was nominated. and appointed
as alternate personal representative in the decedent's Last Will
and Testament.
6. The nature and approximate value of the assets in
this estate are condominium known as Apartment No. B, Building
#108, of High Point of Fort Pierce, Condominium Section I,
value $36,500.00; 1972 Dodge automobile, IDS LH41C2R191049,
value $500.00.
7. Petitioner is unaware of any unrevoked will or
codicil of decedent other than as set forth in paragraph 8.
8. .The original of the decedent's last will, dated
August 28, 1979, is in the possession of the court or accompanies
this petition.
Petitioner requests that the decedent's will be admitted
to probate and that RICHARD P. SIMUNE be appointed personal
representative of the Florida estate of the decedent.
Under penalties of perjury I declare that I have read
the foregoing and the facts alleged are true, to the best of my
knowledge and belief.
