HomeMy WebLinkAbout2710 • 2.6 Common Elements shall include the cultivation and irrigation equipment inc uding but not limited to all pumps, motors, transformers and other tangible personal property required for the maintenance and operation of the condominium, even though may be owned by the Association, as described in Exhibit "C" hereto attached, as well as the items stated in the Condominium Act. 2.7 Common Expenses Include: a. Expenses of administration, insurance, maintenance, operation, repair, replacement and betterment of the common elements and taxes on the common elements. b. Expenses declared common expenses by provisions of this Declaration or the By-Laws. c. Any valid charge against the condominium property as a whole. . 2.8 Condominium means all of the condominium property as a whole when the context so permits. 2.9 Condominium Act means and refers to the Condominium Act of the State of Florida. 2.10 Declaration, or Declaration of Condominium means . this instrument, as it may be amended from time to time. 2.11 Declarant means Milton H. Hatfield, as Trustee. 2.12 Institutional Mortgagee means a bank, savings and loan association, or insurance company authorized to do business in the United States of America, an agency of the United States Government, a real estate or mortgage investment trust, or a lender generally recognized in the community as an institutional lender. 2.13 Singular, Plural, Gender. Whenever the context so permits, the use of the plural shall include the singular, the singular the plural, and the use of any gender shall be deemed to include all genders. 2.14 Utility Services as used in the Condominium Act ~ } and as construed with reference to this condominium, and as used in the Declaration and By-Laws, shall include but not be limited to electric power, gas, water, garbage and sewage disposal. 3. CONDOMINIUM PLAN. The condominium is described and established as follows: 3.1 Survey and Plans. The division of-the Land into separate units is made substantially in accordance with the survey map as shown on Exhibit "A" attached hereto and made a part hereof. Each unit shall consist of an area of land as described in Exhibit "B" hereto together with the citrus trees situate thereon. z 3.2 Easements. a.
