I, I~RLgWS B. NEAR, a citizen and resident of Fort Pierce,
Florida, having in mind the nature and extent of my property, also J. ~
my obligations to my wife, relatives and friends, do, after carefuly
deliberation, make, publish and declare this to be my Last Will and
Testament, and hereby revoke all other Wills and codicils at any
time heretofore made by me.
FIRST: I desire and direct that my remains be interred in
my plot in the Mount Pleasant Cemetery at Canastota, New York. The
year of death is to be added to the marking now on the head stone
grave marker which is in place. Remains to be disposed of as my
wife may wish. If my wife is not living Cremation shall be the
means used.
SECOND: After payment of my debts, funeral expenses, estate
taxes and the cost of administering my estate, I give, bequeath
and devise all the rest and residue of my estate, real and personal
wherever situated, to my wife, ELSIE B. NEAR, if she survives me.
THIRD: In the event that my wife, ELSIE B. NEAR, does not
survive me, then I dispose of and direct the distribution of the

(a) I give and bequeath the swn of One Thousand Dollars
($1,000.00) to Lt. Col. HUGH K. CONDY (Ret) and/or his wife, VIRGINIA
CONDY, (not to their children) 323 Holly Avenue, River Park, Fort
Pierce, Florida 33450; if living at the time fixed for distribution
of my estate.
(b) I give and bequeath the sum of One Thousand Dollars
($1,000.00) to WILFRED C. ZAPF and/or his wife FRANCES ZAPF (not to
their children) 609 South 6th Street, Fort Pierce, Florida 33450,-
if living at the time fixed for distribution of my estate.
(c) I give and bequeath the sum of One Thousand Do~.lars
($1, 000.00) to CAROL (Mrs. W. H. ) WILLETT, (a widow) (not to her
children) 68 Ontario Street, Corning,-New York 14830, if living at
the time fixed for distribution of my -estate.
(d) I give and bec,~ueath the sum of One Thousand Dollars
($1,000.00) to my sister-in-law, LILLIAN B. BUCHidALD, 4127 -49th
Street, Long Island City, New York 11104, if living at the time
fixed for distribution of my estate.
(e) I give and bequeath the sum of One Thousand Dollars f
($1,000.00) to my sister-in-law, GERTRUDE B. (Mrs. George)MeCARTHY,
228 Grand Street, Westbury, New York 11590, if living at the time t
fixed for distribution of my estate.
(f) I give and bequeath the sum of One Thousand Dollars
($1,000.00) to my sister-in-law, GLADYS B. BRUCHHAUSEN, 4127-49th
Street, Long Island City, New York 11104, if living at the time
fixed for distribution of my estate.
(g) I give and bequeath the sum of One Thousand Dollars
($1,000.00) to the Mount Pleasant Cemetery Association, Canastota,
New York 13032, for the Perpetual Care Fund to be used for the
care of the combined Petrie-Near plot only.
