(hj After payment of my debts, funeral expenses, estate
taxes and the cost of administering my estate, I give, bequeath ~
and devise all the rest and residue of my estate, real and personal
to the said LILLIAN B. BUCI~TALD, GERTRUDE 8. McCARTHY, GLADYS B.
BRUCHHAUSSN, WILFRED C. ZAPF and FRANCES ZAPF, husband and wife, of
Fort Pierce, Florida, (as to one share only), Lt. Col. HUGH K. CONDY
and VIRGINIA CONDY, husband and wife, of Fort Pierce, Florida, (as to
one share only), CHARLES T. SYKES and/or MARJORIE SYKES, his wife,
30 Burton Street, Cazenovia, New York 13035 (as to one share only). {
In case none of the aforementioned are alive divide equally between
my sister MINNIS (Mrs. Norman) TAYLOR, a widow, 329 Forest Hill
Drive, Syracuse, New York 13206 (not to her children) and my only
first cousin ETHBL (Mrs. Ralph] HULETT, R. D. 2, Sinclairville,
New York 14782 (not to her children).
FOURTH: I hereby nominate and appoint my wife, ELSIS B. NEAR,
sole Executrix of this my Last Will and Testament, and I hereby
expressly confer upon her power as such Executrix to administer
my estate, and direct that she be excused from giving any bond. y
And I hereby further expressly authorize and empower my said
Executrir_. in her stele and absQlute~dis~retion and w3th~+~t the
order of any Court, to bargain, sell rent, lease, convey, transfer,
convert or otherwise dispose of, or grant options with respect to, ,
any and all property fonaing a part of my estate, in such manner, at
-such time or times, for such purposes, for such prices and upon
such terms, credits and conditions as she may deem advisable, and
to make, execute and deliver any and all instruments in writing '
which she may .deem advisable to carry out any of the foregoing
powers. Tf she should fail to qualify or cease to act as Executrix
hereunder, I appoint the FIRST NATIONAL BANK OF FORT PIERCE, Fort
Pierce, Florida, to be the Executor of this my Last Will and
Testament in her place and stead, and hereby expressly confer and
bestow upon it as my alternate Executor all and singular the dis-
cretionary and other powers and authority in-the administration
of my estate with which my said wife would have been clothed had
she served as Executrix.
IN WITNESS WHEREOF, I have set my hand and seal to this my
~ Last Will and Testament contained ~n two typewritten sheets of
~ paper, upon the foregoing of which I have also written my name,
at Fort Pierce, Florida, this day of July 1971.

The foregoing instrument was subscribed on the first page and
at the end thereof by F~iRL(7WE B. NEAR, the above named Testator, and
by him signed, sealed, declared and published as his Last Will and
Testament, in the presence of us, the undersigned, who, at his
special instance and request, do attest as witnesses, after said
Testator has signed his name thereto, and in his presence, and in
the presence of each other, at Fort Pierce, Florida, this July t
1971.
