FINAL JUDGMENT AGAINST GARNISHEE
THZS CAUSE came before the Court on non-jury trial
on December 6 and 11, 1979. The Court received testimony,
memoranda of law and argument of counsel for all parties. From
the testimony and exhibits introduced at trial, the Court finds
and determines:.
This is an action on a writ of garnishment by Plaintiff,
Port St. Lucie Bank, against U.S..General, Inc. as garnishee

(hereinafter referred to as "Garnishee") on the judgment obtained
by Plaintiff against Robert C. Amann. The issues are framed by
t reply and traverse of Plaintiff to Answer of Garnishee. There
are three issues involved,'•namely: (1) whether the note from U.S.
General, Inc. to Robert C. Amann in the amount of 55,200 was fraud-
ulently cancelled; (2) whether the bill of sale from Robert C.
Amann to U.S. General, Inc. was a fraudulent transfer; and (3)
whether there were any payments for a debt that U.S. General, Inc.
made to Robert C. Amann between the service of the writ of gar-
nishment and the answer of U.S. General, Inc.
Plaintiff originally filed suit against the Defendants
Robert C. Amann and Marie A. Amann, his wife on August 18, 1978,
alleging default on a mortgage by failing to make payments due and
by the filing of a petition by the maker of the note, R-Cam Homes,
Znc. under the Bankruptcy Act. Marie A. Amann subsequently filed
