OF HUTCHINSON ISLAND, INC., moving to dismiss Count II and the
Motion of BEN WOOD CONSTRUCTION, INC., moving to dismiss Count III.
The Court hearing argument of counsel and otherwise being fully
advised, it is
ORDERED AND ADJUDGED that the Motion to Dismiss filed by
OCEANRISE OF HUTCHINSON ISLAND, INC. as to Count II be~, and the
same is hereby granted, and Plaintiff is granted leave to file
an amended complaint .within twenty (20) days from the date of this
Order.
