This action was heard on the Motion to Dismiss for lack of prosecution
of Defendants, CITY OF FORT PIERCE and AETNA CASUALTY AND SURETY COMPANY.
The Court finds that it does not affirmatively appear from filing of plead-
ings, Order of Court, or otherwise for a period of one year before serving
the Motion that the action is being prosecuted, therefore, it is
ADJUDGED that this action is dismissed for lack of prosecution, that
