so that neither I serve as trustee, nor he serves as successor
trustee, I hereby nominate and appoint my son, JOHN M. McCARTY, JR.,
as my successor trustee to my Mother's trust estate; and in case he
does not choose to qualify or cannot qualify as my successor trustee,
I nominate and appoint my brother, JOHN C. FOSGATE, as my successor
trustee; and in case he does not choose to qualify or cannot qualify
as my successor trustee, I nominate and appoint-the FIRST NATIONAL
HANK OF. WINTER PARK as my successor trustee.
V.
I hereby nominate, constitute and appoint my husband, JOHN M.
McCARTY, sole Executor of this my Last Will and Testament, and I ex-
pressly confer upon him power as such Executor to administer my
estate, and direct that he shall not be required to give bond, sec-
unity or surety for the faithful performance of his duties under
this Will and Testament nor be required to make any returns to any
Court.
- In the event the said JOHN M. McCARTY should predecease me or

should for any reason become incapacitated to act as Executor of my

estate, then and in that event I nominate my brother, JOHN C. FOSGATE,

as his successor, succeeding to like duties, powexs and authority,
and I direct that he shall not be required to give bond, security or
surety for the faithful performance of his duties under this appoint-
~ ment.

The foregoing instrument was signed, sealed, declared and pub-
{ lisped by LOUISE FOSGATE McCARTY as her Last'Will and Testament in
the presence of us, the undersigned, who, at her special instance
and request, do attest as witnesses after •the said Testatrix has
signed her name thereto and in her presence and in the presence of
each other, the day and year last above mentioned.
