This mortgage also secures any and all renewals and extensions of the promissory note referred to herein and secured hereby, and all installments thereof, and also any other notes which have been or may be given to the Mort- gagee by the Mortgagor. and any other indebtedness of the Mortgagor to the Mortgagee which, however, shall not exceed at any one time the aggregate unpaid principal sum o[ N/A . DOLLARS It .......-Q-.........). it being the specific intention that further advances may be made by the Mortgagee at its option to the Mortgagor, either prior to or after the due dates o[ the above referred to promissory note hereby secured; and this mortgage ie given for a the specific purpose o[ securing any and all indebtedness by the Mortgagor to the Mortgagee in whgtever manner the ~ same may be evidenced or represented, until this mor/gage is satisfied of record; and all covenants and agreements con- t twined in this mortgage shall be applicable to all further and future advances made by the Mortgagee to the Mortgagor and all other indebtedness of Mortgagor to the Mortgagee, and any and all renew:~ts or extensions thereof. 16. It all or any part o[ the property or an interest therein is sold or trnnsterred by Mortgagor, excluding (a) the creation of a lien or encumbrance subordinate to this mortgage or (hj the creation o[ n purchase money security inter- est for household appliances, then, in that event, the then outstanding principal bnlance of .the note secured by this mortgage, together with accrued interest, costs and future advances, if any, shall immediately be due and payable. Any such transfer of conveyance made without satisfaction of this mortgage shall constitute a default under the note and mortgage securing same. 17. If Mortgagee deems itself insecure, or upon the happening o[ :any of the following events, each o[ which shall r constitute a default hereunder, all liabilities of each Mortgagor to Mortgagee shall thereut~on or thereafter, at the option of Mortgagee, without notice or demand, become due and payable: (a) the death of any Mortgagor wwhich term shall mean and include each Mortgagor, co•maker, endorser, surety and guarantor of this mortgagel: tb) the filing of any petition under the Brankruptcy Act, or any similar tedeml or state statute, by or against any Mortgagor; fc1 an appli- cation for the appointment of a receiver for, the making of a general assignment [or the benefit of creditors by, or the insolvency of any Mortgagor: (d) the entry of a judgment against any 1ortgagor; le) the issuing o[ any attachment or i garnishment against any property of any Mortgagor; If) the taking of possession o[ any substantial part of the. property ~ of any Mortgagor at the instance of any governmental authority; (g) the dissolution, incompetency, merger, rnnsolida- ~ lion, or reorganization of any Mortgagor. 18. This I?lortgage Deed and the note it secures shall be construed only under the laws of the State o[ Florida. ~ PROVIDED ALWAYS, and this mortgage is on the express condition, that i[ the Mortgagor shall well and truly pay unto the Mortgagee the said sum of money mentioned in said promissory note referred to herein and secured hereby and any renewals or extensions thereof, any further advances and any other indebtedness referred to herein, in what- ever form, and the interest thereon as it shall become due, amording to the true intent and meaning thereof, together with all costs, charges and expenses, including a reasonable attorney's tee, which the Mortgagee may incur or be put to in collecting the same by foreclosure or otherwise, or in protecting the security of the Mortgagee, whether by suit or otherwise and shall well and truly keep, observe, perform, comply with and abide by each and every the stipulations, agreements, conditions and covenants of said promissory note and this mortgage as and when required thereby then this - mortgage and the estate hereby created shall cease and be null and void, otherwise the same shall remain of binding force and effect.
