AFFIDAVIT
STATE OF FLORIDA
COUNTY OF ST. LUCIE
BEFORE ME, the undersigned authority, personal appeared
JOHN EDGAR SHERRARD, who, upon being first duly sworn by me,
deposes and says: ~
1. That he is the attorney for MERKLE MOTORS, INC., of
Fort Pierce, Florida, and is authorized to make this Affidavit
2. On July 18, 1978 Plaintiff and Defendant entered
into a written Stipulation for the payment of the amount being
sued for in the above case.
3. Under the terms of said agreement, the Defendant
agreed to pay the sum of $25.00 on the 28th day of July, 1978

~ and $25.00 on Friday of each week thereafter, until the sum
of $983.96 plus $23.50 costs were paid in full. _ !
4. nPfendant.made three payments with the last payment
being made on December 7, 1978, but has failed to make any
further payments in accordance with the above-mentioned
Stipulation.
5. That there is presently due, owing-and unpaid under
said Stipulation the sum of $877.46, plus $23.50 court costs,

in ttre~amount of $40.73, for a total of $941.69 owing to date.
Interest•will be added thereto at the rate of $.1547983 ~
per diem from September 17, 1979.
