5. J3ines R. Duggan, Jr., Petitioner herein, whose
address is 67 North Highlands Avenue, Avon Park, Florida, is
entitled to preference in appointment as Personal Representative
because he was named by the decedent as her choice for Executor
in her Last Will and Testament, previously filed with this Court.

6. The nature and approximate value of the assets of s
the decedent's estate are:

7. Petitioner is unaware of any unrevoked will or
codicil of the decedent, other than as set forth in paragraph #
eight (8) below.
8. The original of the decedent's Last Will, dated
the 18th day of October, 1971, and witnessed by LILLIAN M. BAKER,
THEDA D. MIRACLE, and ALINE LYLE, is in the possession of this
Court. Petitioner requests that the decedent's Will be admitted

to probate and that-JAMES R. DUGGAN, JR., be appointed Personal
Representative of the Florida estate of the decedent.
