B. In lieu of declaring a forfeiture,
accelerate and bring an action for the balance of the purchase

price remaining due, or for any other relief available in law or f
~ nauity; including suit to recover any payment or payments made by
i
the Sellers and repayable to the Buyers hereunder, it being !
stipulated and agreed that such obligation to re-pay is a
i
separate and independent covenant of the Buyers. No action to
i
recover any payment or payments so made by the Sellers shall !
constitute a waiver of the rights to proceed otherwise with

respect to any subsequent default.

C. No waiver by the Sellers of any default of 1
the Buyers shall be construed as a waiver of any subsequent de-
fault. ~ ~
10. The parties acknowledge that default shall be
construed as having occurred hereunder when the payment as re-
quired by the Buyers shall have been delayed or not made within
Thirty ( 30) days of the due date thereof .
11. It is agreed that the Sellers shall continue
to be responsible for all Mortgage payments due FIRST FEDERAL
SAVINGS AND LOAN OF FORT PIERCE, and to keep current in all
j respects those provisions as set forth in the Mortgage and Note
due the said Mortgagee. In the event Sellers shall default in b

the performance of any of their obligations thereunder, Buyers
shall have the right to cure such default and to apply the full
amount of any monies so paid to the reduction of the indebtedness
f
due the Sellers under the terms of this Agreement.
12. Sellers further warrant that the central
airconditioning and plumbing throughout the home shall be in ~
proper -working condition throughout the home. In all other
i
respects the Buyers accept the premises in its "as is"
condition. '

13. The closing of the within transaction shall be
at the offices of HAROLD H. GOLDMAN, ESQUIRE, 8028 SOUTH FEDERAL :
HIGHWAY, PORT ST. LUCIE, FLORIDA 33452, on or about January 12,
~ 1980, at 11:00 A.M.. At the time of the closing Seller's shall
be res onsible for the documentar stam s necessar to be affixed
