THIS CAUSE having come on before the Court upon the Motion
of the Plaintiff, LANDMARK FIRST NATIONAL BANK OF FORT LAUDERDALE, for
relief from the Final Judgment previously entered by this Court on
September 17, 1979, in this matter, and the Court having been advised
by counsel for the Plaintiff that the property which is the subject

of this action, to wit:
One used Allis Chalmers Front End Loader
~ Model No. 940 (articulated) I.D. No. 1015,
is believed by the Plaintiff to be presently operated by the Defendants at
~ certain premises located in Broward County, Florida, and the Court having
been further advised by counsel for the Plaintiff that the Plaintiff desires
to attempt to obtain possession of the subject property, and the Court having
previously found and determined that the Plaintiff has the sole right of
~ ownership and possession of said property, and the Court having found that
he Final Jud ent reviousl entered in this cause was entered as a

consequence of certain fraudulent representations made to the agent of the
Plaintiff as to the location and existence of the subject property, and
the Court being otherwise fully advised in the premises, it is thereupon
ORDERED AND ADJUDGED that the Plaintiff, LANDMARK FIRST-NATIONAL
BANK OF FORT LAUDERDALE, a national bank, have possession and ownership
