LUCIE COUNTY, FLORIDA s 9 WHEREAS, the Board of Adjustment of St. Lucie County, Florida, based on the testimony to and evidence, including, but not limited to the staff report, has made the following 11 determinations: 12 13 1. Eugene and Dianne Nawrocki presented a petition for a Variance from the 14 provisions of Section 7.04.01(Table 7-10), of the St. Lucie County Land 15 Development Code to permit the construction of a swimming pool screen 16 enclosure which will encroach a maximum of 5 feet into the minimum rear 17 setback of 20 feet required in the PUD (Planned Unit Development - is Harbour Ridge) Zoning District for the property depicted on the attached 19 maps as Exhibit "A" and described below. 20 21 2. On June 23, 2010, this Board held a public hearing on the petition, after 22 publishing a notice of such hearing and notifying by mail all owners of 23 property within 500 feet of the subject property. 24 25 3. After consideration of the testimony presented during the public hearing, 2 6 including staff comments and the standards of review for granting variances 27 set out in Section 10.01.02, St. Lucie County Land Development Code, the 28 Board of Adjustment has made the following determination: 29 3 o The requested variance has met the standards of review as set forth in 31 Section 10.01.02, St. Lucie County Land Development Code and is not in 3 2 conflict with the goals, objectives, and policies of the St. Lucie County 3 3 Comprehensive Plan, because: 34 3 5 1. The variance granted is the minimum variance required to improve the 3 6 safety conditions of the structure. 37 3 s 2. The variance granted will not have adverse impacts to other property 3 9 or improvements in the neighborhood. 40 41 3. NOW, THEREFORE, BE IT RESOLVED by the Board of Adjustment of St. Lucie County, Florida: A. Eugene and Dianne Nawrocki presented a petition for a Variance from the Provisions of Section 7.04.01(Table 7-10), of the St. Lucie County Land Development Code to permit the construction of a swimming pool screen enclosure which will encroach a maximum of 5 feet into the minimum rear setback of 20 feet required in the PUD (Planned Unit Development - Harbour Ridge) Zoning District for the property depicted on the attached maps as Exhibit °A". B. The property on which this Variance approval is granted is described as follows: UNIT 8, HARBOUR RIDGE, PLAT NO. 9, AS RECORDED IN PLAT BOOK 27, PAGES 1, 1A THROUGH 1D, PUBLIC RECORDS OF ST. LUCIE COUNTY, FLORIDA. Location: 1465 NW Sweetbay Circle Parcel I D: 4426-804-0041-0007 B. This variance shall expire twelve months from the date of adoption unless a building permit is approved or an extension is granted in accordance with Section 10.01.06, of the St. Lucie County Land Development Code.
