The aforesaid obligation evidenced by the said promissory note
shall be secured by a second mortgage covering the aforesaid
marital residence executed iz favor of the Husband by the Wife.
Said mortgage shall contain provision(s) wherebp the ass-igament -

or assumption of same without the express prior written consent
of the Husband is-.prohibited. - -
Fu!-ther, Husband and Wife-agree that said marital resi- -

deuce is encumbered as the result of a first mortgage in favor of
Stuart National Bank wherein they sre co-mortgagors and co-melcers -
of the particular promissory note secured thereby.
The Husband agrees to maintain his present status under
both said first mortgage and note past execution of this Agreement. -
However, the Wife hereby expressly agrees to refrain from partici-
pating_in any action having the effect of causing an assignment or
an assumption by any person of said first mortgage and note without -
.first obtaining the express written apFraval of the He*.Sband. Fur-

ther, the Wife agrees to execute any legal document gresgnted to
her designed bur 3imited to modifying aue3~or amending the afore-
_ -
said-first mortgage and note to reflect thereon the aforesaid
j limitation against assignment and/or assumption.
! The Husband shall execute and deliver to the Wife upon
the signing of this Agreement a quitclai~q deed-conveying any, and- - -
every right, title crud interest he possesses in the said marital
residence. -

~ Tha Wife shall assume responsibility commenting with -

the date of signing this Agreement f-or the payment of taxes, xe- -

pairs, insurance, mortgages and any other expenses conuected with

the upkeep of the home.
