County of Dutchess, State of New York, do hereby make, publish
and declare this_tU be:aty Last will and Testament.
. FIRST: I hereby revoke all wills and codicils made
by me at arty time before.
S8(.~OND: All- of my estate, both real and personal,
of every nature and whereever "situated; I give, devise and-bequea
to mg beloved wife, JOAN McGRATH.
THIRD: But if, my wife, -JOAN - *lcGRATH, does not
survive tee, or if she and_I.die at the same time or in a common
~ disaster or under such circumstances that it is difficult or
- impossible to dP~-.er~aine which died first, I then give, devise
-
and bequeath my estate in equal shares, per stirpes, to.my
children now living or after-born.
FOUItTBI: Any person who shall have died at the same-
time as I or in a common disaster with me, or under such
circumstances that it is difficult or impossible to determine
which died first shall be deemed to have predeceased me. -
FIFTH: This Last will and Testament shall be
construed~accordinq to the Law of the State of New York.
SIXTH: I appoint my wife, JOAN McGRATH, Executrix
of my Last Will and-Testament. But should my wife predecease
me, or be unable to serve as Executrix, I appcsint MARTIN. W. ~

Mc:GRATH,~presently of Englishtown, New Jersey, to be my Alternate

and SUbstitnte Executor and C,uardian of such of my children
as shall be minors at the time of my death.
