Motion was meritorious did, howe~rer, grant-Plaintiff's oxe tenus Motion for the
submission of a ~rritten Memorandum of Law in opposition to Defendants' Motion
for SLa¦iary Judgment, said Memorandtaa to be filed within twenty days of entry
of this Court's Order on December 7, 1979, and upon failure of Plaintiff to~-
file his Menorandva of Law, it is - ~ -
ORDERED AND_ADJUDGED that Final Summary Judgment be and hereby is entered
fir the Defendants, CITY OF FORT PIERCE, FLORIDA, and ABTNA CASUALTY AND SURETY
COI~ANY, and against the Plaintiff, EUGENE CARTER, and it is further
ORDERBD AND ADJUDGED that the Court reserves ruling on taxation of costs
pending proper Motion acrd hearing on this matter.
