PBTT_TION FOR RBVOCATION OF PROBATE AND
PETITION TO RSVORB WILL -
JOHN ROSSI and ROSE HARRIS, by and through their under-
signed attorneys, petition the court for revocation of probate -
. and petition to revoke Will and state as follows.: -
- - 1. Petitioners herein deny that the Last -Will ar~d Testa-
went of-Aneillo Rossi dated March 19, 1979, which Will was
admitted. to probate by order of this-court dated September 14,
1979 as the valid Last Will and Testament of-Decedent. Peti-
tioners further deny that MARIB HURRAY is entitled- to be
appointed personal representative of thQ decedent's estate
- 2. Petitioners are- two (2) of the natural born children
of the decedent, ANIBLLO ROSSI.
' 3. On. March, 1979, the decedent, ANIELLO ROSSI, was_not

i of sound and disposing mind nor mentally capable of making a- -
I - -
- Will. At that time-, ANIELLO ROSSI was of such advanced age
- that his senility rendered him imcompetent to such a degree -
that he did not comprehend the nature and ,extent and disposi-
tion of his estate in relation of those who had or might have
had a claim on his bounty. Further Petitioners would state
that at the time the alleged Will was executed, ANEILLO ROSST
was acting under the undue influence of MARIE HURRAY with whom .
the decedent resided prior to the execution of the Wi11.
~ WHEREFORE, Petitioners respectfully -request that the-
Order Admitting the Will of Aniello Rossi to Probate and the
Order appointing Marie Murray as Personal Representative be
~ revoked. and that-the Last Will. and Testatment of Aniello Rossi
dated March 19, 1979 be set aside for naught.
