FUGERE, . tidYYARD - Respondent. ) This matter comes before the Court by virtue of the filing of a Summons and Complaint by Petitioner on Feburary 14, 1978, in which Petitioner alleged - that the parties hereto are husband and wise, that two children have been born - as a cesult of the union; and that Respondent separated hereself from-the Petitioner on or about April 26, 1977.. The records reflects that the Respondent was duly served with a - copy of -the Summons and Complaint on May 30, .1979, and that the Respondent did not respond to-same. The matter came to be heard before me on September 24, 1979, / in Chambers at which -time testimony was heard from Petitioner and Kevin Wayrie ! ~1 Ludwig and it was determined that no collusion existed. I find that the parties hereto were married on October 14, 1966, in Corpus Christi, Texas. I find that after the marriage until on or about April 26, 1977, the Petitioner- and Respondent shared a suitable home; however, Respondent wiled and refused to cohabit with Petitioner after April 26, 1977. I find that Respondent moved #rom the marital home taking the two (2) miner children of the parties and has stayed so absent until this date. I find that the Respondent contributed nothing to the purchase of the three (3) Florida lots and that Respondent's interest therein should be expunged. 1 find, after close inquiry that there is no possibility of reconciliation. - _ - ~ I find that the Petitioner is entitled to an absolute divorce from the Respondent on the grounds that they have been living separate and apart for more than one (1) year.- It is therefore ORDERED, ADJUDGED AND DECREED that the bonds of matrimony . _ existing by and between Petitioner and Respondent are hereby dissolved, a vinculo . ~ - - ' ~ maitri~monii, that the said parties are, and each of them is, hereby freed and absolutely ` J ~
