PETITION TO SET ASIDE HOMESTEAD REAL ESTP~TB
The Petition of Anne Sanderson respectfully shows:
1. Walter H. Sanderson died testate a resident of
St. Lucie County, Florida,_on November 27, 1979, owning -
land in St. Lucie County described in the Exhibit attached
hereto. - -
2. The aforementioned parcel of~real property consists
of approximately five (5) acres and is not located within
any municipality. ~ -
At the time of decedent's death, he resided on the
property as the head of a family consisting of deoedent and
his wife, Anne Sanderson.
4. The decedent died without any descendants surviving. -
' 5. Petitioner believes and therefore alleges that the -
aforementioned real property~COnstitutes homestead real
property within the .meaning of Article X, §4 of the Florida
Constitution, and decedent being survived by a surviving spouse
and no descendants, and said propery not being specifically
devised by will, it descends as provided in~Florida Probate
Code 732.402 to Petition. in fee simple.
WHEREf'ORE, Peti _ioner asks that .this Court will enter
an Order finding the aforementioned parcel of real property
to be homestead property and that it descends to Petitioner - -
