ORDER-
THIS CAUSE came before the Court on Plaintiff's,
Frances Battiloro, response to this Court's order dated January
4, 1980, and the Court finds that oral argument is needed on the
question of whether Plaintiff will be~able to submit some evidence
~ _
~ at the trial as to the permanent in3ury, or whether the Plaintiff,
Frances Battiloro,-has sustained serious non-permanent iniuries, f
the effects of which are medically and scientifically demonstrable ~
as provided in F.S. 627.737(~(e)(1977). See .problem presented by
{
Johnson v. Phillips, 345 Sold 1116 (2 DCL~ 1977) , and Howard v. _
Newrsan, 363 So2~1 65 (1 DCA 1978) .

Defendants' motion to dismiss Counts III and IV of the Complaint {
