all apartments and to alter the boundar~~s between apartments, as
long as it owns the apartments to be altered. No such change will
increase the number of- apartments nor alter the .boundaries of the. -
coaunon elements without am~:rdment of this Declaration in the aeanner
described in Article 16 hereof. If the Developer shall make any -
changes in apartments, as herein-authorised, such changes will be.
reflected by an amendment of this Declaration; and if more-than one t
apartment is concerned, the Developer shall eQuitably apportion-
- between the•apartments the shares in the common elements appurtenant
to~the apartments concerned, in such proportions as the floor ,space
of each apartment bears to that of every other apartment. However,
no changes or amendments to the design plan of-the-apartments may be
made by the Developer without the consent of- the construction -
mortgagee. - - -
- (b) Amendment of Declaration. When the condominium.-
improvements have bee~3 s stantia ly comp eted, this Decl-aration
shall be amended to include the Certificate of a.Surveyor authorized
to practice in this-State certifying that the construction is sub-
. stantially complete, and that the provisions of this Declaration-
- describing the condominium property, together with the exhibits -
attached hereto, is an accurate representation of the location and -
dimensions of the improvements, and that the identification, loca-
tion, end dimensions of the common elements and of~each unit can be
determined from- these materials. -
- 5.5 Easements are reserved through the condominium
property, as shown in the Exhibits, in order to adequately serve
this condominium and the four (4) other condominiums to be known as
SAND bOLLAR VILLAS, which shall be established and constructed
substantially as shown in Exhibbtt 'A-2" hereto attached; however,
.such easea+ents as may exist or may be requires through an .apartment

easements there is reserved to the Association,-its agents, f
successors or assigns and .to-the apartment owners their agents,
heirs or assigns, and to the apartment owners of the four (4) other

or assigns, the right of ingress, egress and access to such an
extent as may be necessary or required for the-full use, enjoyment,
maintenance or repair o-f said easement or any improvements using or
located thereon. _ -
q - 5.6 Easement A urtetiarat. An easement in favor of those
cer-tain parcels of rea property ocated to the West of SAa~1D DOLLAR
VILLAS and described in Exhibit "A-13" attached hereto; is hereby -
reserved through the condominium property described in Exhibit "A-1"
attached hereto for the purpose of providing recreational and beach
use and access to the properties described in Exhibit "A-13".. This
easement shall, in part, provide for access over and across
roadways; parking lets, sidewalks, bridges and walkways providing
direct. access to the recreational facilities of the SAND DOLLAR ~
VILLAS Condominiums and to the beach as such appear according to the
plans and specifications for the condominium, or as the building is I
constructed. This easement-shall give to all residential unit
property owners of units contructea upon the properties described in
- Exhibit "A-13" o€ this Declaration the right to full use and
enjoyment of all recreational facilities in-SAND DOLLAR-VILLAS
~ Condominiums A, B, C, D and E, as shown in the Exhibits to-this
